Italian citizenship: ruling may change thousands of cases
On April 14, 2026, the United Sections of the Court of Cassation will rule on one of the most sensitive issues in Italian citizenship by descent: the so-called minor issue. This legal debate may directly impact thousands of citizenship recognition cases worldwide.
The central issue involves the interpretation of Articles 7 and 12 of Law No. 555/1912. The Court must decide whether a child born abroad, who already held another citizenship from birth, retains Italian citizenship even after the parent’s naturalization during the child’s minority, or if it is automatically lost.
